Indenture

Grantor: William Atkins

Grantee: Jacob Christopher

That whereas the Lord Proprietary did grant to Robert Atkins all that tract called Durham lying on the bay side. Beginning at a marked pine standing on the southward side of a ridge back in the woods about six miles from Wiccomoco River and about half a mile from the said Robert Atkins. This containing 50 acres.

Also the Lord Proprietary did grant to Robert Atkins all that tract called Dunkirk lying on the bayside. Beginning at a white oak standing on the southeast end of a ridge in a low piece of ground within sight of the dwelling house of the said Robert Atkins and laid out for 50 acres. Also the Lord Proprietary did grant unto John Jenner all that tract called Magdalens Choice lying back in the woods about 4 miles from the south side of Rockiwakin River and about two miles from Tundotank Indian Town. Beginning at a marked white oak standing by the side of slash and containing 100 acres.
The said John Jenner died without making any disposal of this land and so his heirs became possessed of the land and it was conveyed to Robert Atkins (now deceased). This conveyance to Robert Atkins is found in a deed "from the hands and seals of Abraham Highway and Margaret his wife" dated 19 August 1719. The above named William Atkins is the heir at law to the lands of his deceased father, Robert Atkins. William for "divers goods causes" and for the sum of 50 pounds sells this land to Christopher

Met the 11th day of June 1761 according to appointment
David Polk aged fifty six years or thereabouts being Sworn saith about eight or Ten
years agoe he was at the setting up of a Ceadar post as a bounder of Wm Disheroones Land
and that John Christopher Senr was present and said that was the place where John Frizels
bounder formerly stood and that it was a pine that he was not at the marking the sd.
bounder but saw it soon after that some person told him the said Christopher that it
was the bounder of Frizels lLand and John Mears being presents said no the bounder
says Mears is an oak, it is a Lye says sd. Christopher the bounder is a pine and further
saith not David Polke
John Dishroone aged fifty two years being Sworn saith that he was present at the set
-ting up of the Ceadar post aforesd. and John Christopher being there said that the bounder of
John Frizels Land stood where They were going to set up the said post and that it was
a pine for his father had told him soe and John Mears Being there contradicted
Christopher you are a Lyar says Christopher the bounder was a pine Tree and fur
-ther saith not John Disheroon
We do hereby certify that agreeable to the within commission we mett on the Land
therein mentioned, after having complyed with the directions of the act of assembly in
such case made by setting up advertisements agreable to the said act and took the above
and within depositions Witness our hands and seals this 17th day of June 1761

PETITION FOR AN ACT TO PROMOTE THE ADVANTAGES OF THE TOWN OF SALISBURY,
SOMERSET COUNTY, 1763

[THIS PETITION WHICH WAS PRESENTED IN THE LOWER HOUSE OCTOBER 22,
1763, AND THERE REJECTED, PRAYED THAT THE ACT OF ASSEMBLY PASSED IN
1732 FOR ERECTING A TOWN AT THE HEAD OF Wicomico RIVER, SOMERSET
COUNTY, AT HANDY'S OR CARR'S I-ANDING, ON FIFTEEN ACRES OF LAND
LAID OUT IN TWENTY LOTS, CALLED SALISBURY, BE REPEALED AND A NEW
ACT PASSED TO BE FRAMED BY THE PETITIONERS FOR THE PURPOSE OF
BETTER PROMOTING THE ADVANTAGES OF THE TOWN. THIS MATTER WILL
BE FOUND DISCUSSED ON PACE XXXIV.]

To The Hon.ble Lower House of Assembly
The Humble Petition of many Inhabitants of Somerset County, Sheweth

That on or about the Year I732 an Act of Assembly of this province
passed Entituled An Act for the Erecting a Town at the Head of
Wiccomoco River in Somerset for laying into Lots fifteen Acres
of Land in the Fork thereof and at the Landing commonly now called
Handy's or Carr's Landing by which Twenty Lots were laid out & a
Town was erected & called Salisbury. That although the said Town
is very comodiously situated for Trade and Navigation very few
Lots were taken up under the said Law it being thought insufficient
through the Omission of several Clauses which are now deemed
essentially necessary for many persons inclinable to purchase
Lots in the said Town.

That your Petitioners humbly conceive it would be of great Utility
to all the Inhabitants in or near the said Town and to all persons
trading to and from thence to have an Act passed by the Legislature
to repeal the aforesaid Law and to have Leave given to your Petitioners
to frame a new Bill particularly adapted for the Uses and purposes
of the encreasing and promoting of the Advantages of the said Town.

Your Petitioners therefore humbly pray that your Honours will give
Leave to bring in a Bill for the purposes aforesaid And your
Petitioners in Duty bound will pray,
